Terms of Service

TheTopSpot sells paid promotional placement on a public leaderboard. Your payment buys a listing on that leaderboard for as long as the ranking rules below keep it there. You are not buying advertising performance, editorial coverage, an endorsement, a backlink for search-engine purposes, or any guaranteed level of exposure.

Every listing is labeled “Sponsored” and every outbound link usesrel="sponsored nofollow noopener noreferrer".

• Ranking is determined solely by the amount successfully paid, in descending order.
• The highest successful payment occupies position #1, the second-highest #2, and so on.
• If two listings paid the same amount, the earlier successful payment ranks higher.
• A listing keeps its position until another listing is published with a higher successful payment.
• When someone pays more than you did, your listing moves down. This is the expected behavior of the Service and is not a defect.
• Rankings are recalculated automatically from confirmed payments. We do not sell fixed positions, and positions cannot be reserved beyond the checkout reservation window.

When you reach the payment step, your bid amount is reserved for a limited window (10 minutes by default). During that window no other buyer can reserve or pay the same or a lower amount for a higher position. If the reservation expires before your payment is confirmed, the amount is released and you must place a new bid.

Your listing is published only after your payment is confirmed by the payment provider on our servers. A browser redirect, a screenshot, or a provider receipt alone does not publish a listing.

Placement does not guarantee traffic, impressions, clicks, leads, sales, revenue, virality, or any other outcome. The Service is provided on an “as is” and “as available” basis. We do not warrant uninterrupted availability, and we may change, pause, or discontinue the Service.

You are solely responsible for the content you submit and the destination you link to. You represent that you own or are authorized to use all names, logos, and marks you upload, and that your listing and destination comply with all applicable laws and with our Content Guidelines.

You grant TheTopSpot a non-exclusive, worldwide, royalty-free license to display your submitted name, description, logo, and link on the Service and in related previews for as long as your listing is published.

We may hide, edit, or remove any listing, and block any destination domain, at our discretion — including for content that violates the Content Guidelines, that is deceptive, that harms users, or that exposes us to legal risk. Removal for a violation does not entitle you to a refund except as described in the Refund Policy.

Payments are processed by Stripe and PayPal. TheTopSpot never receives or stores your full card details. All amounts are shown and charged in US dollars unless stated otherwise. You are responsible for any taxes applicable to your purchase in your jurisdiction.

Chargebacks, disputes, and reversals may result in immediate removal of the listing and may disqualify the domain from future placements.

• Attempting to manipulate ranking other than by paying a higher amount.
• Automated or scripted checkout attempts, or circumventing rate limits and abuse controls.
• Submitting content that you do not have the right to publish.
• Probing, scanning, or interfering with the Service or its infrastructure.
• Using the Service to distribute malware, phishing, or other harmful content.

To the fullest extent permitted by law, TheTopSpot is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid to us for the listing giving rise to the claim.

We may update these Terms. Material changes will be reflected in the “Last updated” date above. Changes apply to purchases made after they are posted; they do not retroactively change the ranking rules that applied to a payment already completed.
